Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the Big Shoes website (the “Site”) and any orders you place with us. By browsing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

You must be at least 18 years old, or the age of majority where you live, to make a purchase. By placing an order, you represent that you meet this requirement and that the information you provide is accurate and complete.

Shipping and delivery are governed by our Shipping Policy, and returns and exchanges are governed by our Returns & Exchanges policy. Both are incorporated into these Terms by reference.

We work hard to display product details, photos, and stock status accurately, but we do not guarantee that descriptions, colors, sizing references, or other content on the Site are error-free, current, or complete. Colors may vary based on your display. If a product you receive is materially different from what was described, please contact us so we can make it right.

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Attempt to interfere with, disrupt, or compromise the Site’s security, including probing, scanning, or testing vulnerabilities without permission.
• Scrape, copy, or harvest content, prices, images, or customer data, or use any automated system to access the Site beyond reasonable browsing.
• Submit fraudulent orders, use stolen payment methods, or impersonate another person.
• Reverse engineer, decompile, or otherwise tamper with the Site.

If you submit reviews, photos, comments, or other content to the Site, you grant Big Shoes a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display that content in connection with the Site and our marketing. You represent that the content is yours to share and that it does not violate anyone’s rights or any law.

The Site and all products are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Big Shoes disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, Big Shoes and its officers, employees, affiliates, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Site or any product purchased. Our total liability for any claim relating to a product is limited to the amount you paid for that product.

You agree to defend, indemnify, and hold harmless Big Shoes and its affiliates from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts. Nothing in these Terms limits any non-waivable rights you may have under the consumer-protection laws of your home jurisdiction.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Site after changes take effect means you accept the updated Terms.
